We advise you to read the present general conditions of sale which determine contractual relations between La Cave de Bonnieux, Quartier de la Gare, 84480 Bonnieux (hereafter "Us") and every person making a purchase (hereafter "You") through our on-line boutique on the site "www.cave-bonnieux.com" (hereafter "the Site"). Every order sent to La Cave de Bonnieux implies the acceptance of these terms of sale. 1. YOUR ORDER You declare to be old of at least 18 years and to have legal capacity, or to be a holder of a parental consent allowing you to make an order on the Site. Every order made on the Site has to correspond to the normal necessities of a housekeeping. We reserve ourselves the right to cancel an order which would seem fraudulent. Our minimum of order is of 6 bottles (1 box) and/or of 5L for the Bag-in-Box ®. It is possible for you to mix the bottles in the boxes. Every order will be accepted only after confirmation from our part by e-mail. The contract will be from then formed. We reserve ourselves the right to refuse an order. 2. PRICES. The selling prices are the one in force at the time of the recording of the order and are in Euros all taxes included (T.T.C), with the exception of transport costs. We reserve ourselves the right to modify prices in the course of the year but we guarantee the rates in effect during your order. Transport costs are chargeable to you and are invoiced in supplement of the amount of the order. They will be indicated to the recording of your order. 3. PAYMENTS. Payments are made at the date of order in several ways: -By bank check at the order of “La Cave de Bonnieux”. -By bank card (Visa, Mastercard, American Express) in secure payment. You authorize in advance your bank to debit your account in the sight of recordings or statements passed on by us, even in the lack of invoice signed with the hand of the card holder. The authorization of debit of the account is given for the total amount of the purchase, possible customs charges and transport included. An invoice will be sent to you at the time of the collection and the expedition. We reserve ourselves the right to cancel any order of a buyer with whom we would have had a dispute concerning the payment of a previous order. 4. DELIVERY. The delivery will be made only after reception of the payment of the invoice. We, through our delivery partner, bind ourselves to respect the delays that he will have granted to us by signature of a trade agreement. However, our responsibility will not be committed, considering delays in delivery attributable to the carrier or of any other fortuitous event. Removals at the cellar will be made from Monday to Friday. Delivery periods are of 72 hours minimum. We undertake to communicate for every product the cases of shortage of stock and to warn you by e-mail. We reserve ourselves the right to send you an equivalent proposition in case of exhausting of the stock. If this one is refused, the sale will be cancelled. We use the carriers that we selected according to our conditions of contract and that undertook by a contractual act. At the reception of the product, you have to verify the correspondence and state of the goods. You have to record on the delivery note, after checking of the integrity of the delivered products, any deterioration or error of order. For lack of such an announcement, you will be presumed to have given up any action in justice on this foundation against La Cave de Bonnieux. In case of problem, please get in touch with our customer service. In case of delay in delivery exceeding 7 days and not due to a case of circumstances outside control, you can cancel the contract by e-mail or accept a new delivery period, without being able to demand a valuable discount. 5. SATISFIED OR REPAYED According to the article L. 121-16 of the Code of the consumption, you have a period of 7 days from the date of emission of the delivery form to return, to your expenses, the product bought, without having to prove motives. Spent this period, the right of return does not apply any more. The product must be returned in its original packing, in perfect state, without outside marking and accompanied with a copy of the delivery order. If the return is due to an error of our part, the expenses of return will be at our charge. In that case, you have to join to the parcel a voucher of the expenses of return so that we can repaid you. You authorize by advance that the returned product would be the object of a detailed control of our part before the exchange or the refund of this one. The sealed products should still be, to be returned. The refund will intervene in a period of 30 days from the reception of the product by La Cave de Bonnieux. 6. PROPERTY RESERVE. According to the law of May 12, 1980 ( n°80-335 ), La Cave de Bonnieux reserve itself on purpose the property of products delivered until the complete payment (collection " under the good end ") of the price and the expenses. You undertake not to resell, to pawn or to give as guarantee, the sold product as long as the sums which are due to us are not entirely paid. The payment defines as the actual collection of the total price for the sold product (wine + transport + extra costs) on our account. In defect, products will be claimed by us. 7. GUARANTEES Our products are corresponding to the current legislation in your country. In case of manufacture vice of the sold product, you dispose of the legal guarantee of the latent defects of articles 1641 and following of the French Civil Code. 8. INFORMATION CONCERNING THE CUSTOMER Your coordinates are of use only to the treatment of your order. They will not be communicated to third parties. You benefit from the possibility of rectifying information concerning you. Except refusal of your part, we will communicate you personalized messages during our operations of promotion. 9. PROOFS The articles 1341 and following of the Civil code notwithstanding, the computer recordings that we keep establish the proof of the contractual obligations of both sides. You can report the contrary proof of the assertions of our part. This mode of proof is acceptable as well for sums lower 800 Euros than superior to. 10. DIFFERENCES AND DISPUTES Any complaint must be sent by mail to La Cave de Bonnieux or by e-mail to the customer service. It will be then examined and treated as soon as possible. In case of difficulties in the application of the present contract, both sides have to look for a privately negotiated solution before starting any action in justice. In case of defeat of the negotiated solution, the dispute concerning the interpretation or the execution of the contract will be the competence of the County Court of AVIGNON ( 84 ), FRANCE. 11. MODIFICATIONS. We reserve ourselves the possibility of adapting or modifying at any time the present General Conditions of Sale which will be immediately carried in the knowledge of the buyer by an on-line update.
